I, HUGO DURAN GARCÉS, who is of age, resident of the city of Yumbo, in my capacity as legal representative of the Company EMPRESA DE AGUAS Y ASEO DEL PACIFICO S.A.-EMAPA S.A. E.S.P., a company that holds ownership of the environmental license of the project “HANDLING, TREATMENT AND DISPOSAL OF SOLID WASTE-CONSTRUCTION AND OPERATION OF A LANDFILL on the grounds of the Colomba and the Guabal farms", located in the jurisdiction of the municipality Yotoco, Valle, Colombia, environmental license that was granted by administrative act by the competent environmental authority (Resolution CVC DG No. 0439 July 27, 2007 and Resolution CVC 0100 No. 0740-377 August 9, 2007), express to you in a very polite manner that our company EMAPA S.A. E.S.P., as the sole owner of the environmental license mentioned above (which is annexed to this communication), has not authorized any of these companies: Green Gas Yotoco SAS, or Green Gas International B.V., or INTERASEO SA ESP, or INTERASEO DEL VALLE S.A. E.S.P.,, to carry out procedures for the CDM project to obtain Carbon Bonds. Therefore, this project cannot be developed as a CDM project until the Company that I represent gives its written express authorization for that purpose.
Also, we inform you that pursuant to the requirements of EB49 our Company EMPRESA DE AGUAS Y ASEO DEL PACIFICO S.A.-EMAPA S.A. E.S.P  made in our name the relevant notification of the project to the Designated National Authority of Colombia, in the framework of rights and obligations that the environmental license granted us, and given our capacity as the sole owners of the environmental license. 

Therefore, we vigorously oppose the actions that these above companies are conducting in an irregular way and we request respectfully that you  stop immediately the procedures for the processing of the CDM project submitted by the companies Green Gas Yotoco SAS, Green Gas International B.V., INTERASEO SA ESP, and/or INTERASEO DEL VALLE S.A. E.S.P.



HUGO DURÁN GARCÉS, mayor de edad, vecino de la ciudad de Yumbo, en mi condición de representante legal de la EMPRESA DE AGUAS Y ASEO DEL PACIFICO S.A.-EMAPA S.A. E.S.P., sociedad que ostenta la titularidad de la licencia ambiental del proyecto de “MANEJO, TRATAMIENTO Y DISPOSICION FINAL DE RESIDUOS SÓLIDOS-CONSTRUCCION Y OPERACIÓN DE UN RELLENO SANITARIO en los predios de las Haciendas COLOMBA y EL GUABAL”, localizadas en la jurisdicción del municipio de Yotoco-Valle, Colombia, otorgada mediante acto administrativo de la autoridad ambiental competente (Resolución CVC DG No. 0439 de Julio 27 de 2007 y Resolución CVC 0100 No. 0740 - 377 de Agosto 09 de 2007), muy comedidamente manifiesto a ustedes, que nuestra empresa EMAPA SA ESP, como titular de la Licencia Ambiental (la cual adjunto) no ha autorizado a ninguna de estas empresas : Green Gas Yotoco SAS, ni Green Gas International B.V., ni INTERASEO SA ESP, ni INTERASEO DEL VALLE S.A. E.S.P., a realizar trámites sobre el proyecto MDL para aspirar a los Bonos de Carbono, y por tanto este proyecto no podrá ser adelantado como MDL, hasta tanto exista una autorización expresa y por escrito por parte de la sociedad que represento. 
Igualmente les informamos que conforme a los requerimientos del EB49 nuestra EMPRESA DE AGUAS Y ASEO DEL PACIFICO S.A.-EMAPA S.A. E.S.P  realizó debidamente ante la Autoridad Nacional Designada de Colombia, en el marco de los derechos  y obligaciones que nos concede la licencia ambiental y dada nuestra calidad de propietarios únicos de la Licencia Ambiental, la respectiva notificación del proyecto, bajo nuestro nombre. 

Por lo anterior rechazamos rotundamente las acciones que estas empresas están llevando a cabo de forma irregular y solicitamos muy respetuosamente detener de forma inmediata el trámite de este proyecto presentado por las empresas Green Gas Yotoco SAS, Green Gas International B.V. e INTERASEO DEL VALLE S.A. E.S.P.
