1) The DOE shall further explain how the continuing and real actions taken by the project participant to secure the CDM status for the project activity were validated by means of reliable evidence in line with paragraph 6 (b) of EB 62 Annex 13, given that the only concrete actions taken between the project starting date (22 February 2007) and the start of validation (29 September 2010) are the Host Country Approval (24 July 2007) and the signature of the ERPA (26 July 2007); whereas the rest of the evidence listed correspond to emails sent between the project participant, the consultant company and the CERs buyer (most of them related to the PDD preparation) during a period of more than three years. Please refer to VVM (version 1.2) paragraph 102 (b). 2) The DOE shall further validate the suitability of the electricity tariff used (590 VND/kWh) in the investment analysis. In particular, the DOE shall clarify why the project participant is not be able to achieve a tariff of 750 VND/kWh that would make the project NPV reach zero given that: a) three similar activities listed in the validation report were able to achieve such tariff; and b) the MoU includes a clause saying that the tariff will be re-negotiated when the electricity market is competitive as per the common practice in Vietnam.
