The first crediting period of the proposed project activity starts after the end of the second commitment period on 31 December 2020. However, current CMP decisions prevent the issuance of CERs for emission reductions that occur after 31 December 2020. Paragraphs 12 and 13 of decision 1/CMP.8 (Doha Amendment) clarify that Parties are able to continue to participate in Article 12 of the Kyoto Protocol for the second commitment period. The CDM Executive Board, in its latest annual report to the CMP, recommended that the CMP provide guidance to the Board on the functioning of the CDM beyond the end of the second commitment period. The CMP has, however, not provided any guidance on this matter. Paragraph 7(a) of Appendix D of decision 3/CMP.1 specifies that CERs shall be issued for commitment periods, using an identifier in the serial number of each CER to specify the commitment period. This decision has been further operationalized through decisions relating to the implementation and operation of the international transaction log (ITL). Issuance of CERs for emission reductions or removals occurring after 31 December 2020 would breach these decisions. Paragraph 5 of decision 4/CMP.7 specified which global warming potential values should be used for the second commitment period. These values are also used for issuing CERs for the second commitment period. The CMP has, however, not specified which global warming potential values should be used after the end of the second commitment period. In the absence of further guidance by the CMP addressing these matters, it is not within the authority of the CDM Executive Board to approve requests by project participants that relate to the issuance of CERs for emission reductions or removals occurring after 31 December 2020. Therefore, the request for registration cannot be approved. |
